First Party Claims

Insurance companies have two purposes. Firstly, to receive your premium monthly premium, secondly to deny, delay, underpay, and defend themselves in order to relieve themselves of your claim with a minimal cost to them. As an insured, the first thing you should do if you experience a loss is to mitigate your damages. The next thing is to contact an attorney to help you report the claim immediately. One of the first defenses that insurance companies raise is the failure to report the claim in a timely manner.

You should, however, seek legal advice immediately and prior to reporting the claim. Insurance company personnel are taught and trained on how to ask certain questions upon first contact with the insured, and to reference a claim from a position that best serves their defense. You are not a claims expert or legal expert, but the insurance company is! Mr. Hernandez has been defending insured rights and suing insurance companies for over 25 years.
